Rape accused freed- court doubt woman stand

August 21, 2017

A Court has recently freed a man accused of rape where the rape survivor accused a man of repeatedly raping her on false promise of marriage. The court observed when the accused was summoned in the police station following the complaint of the woman, he offered to marry her but she refused.

Sessions judge Ramesh Kumar observed, “ Had it been the case of the prosecutrix who had already maintained relations with the accused for the last five years and indulged in physical relation with him allegedly on false promise of marriage and made complaint against him that accused has refused to marry her, she would have certainly agreed to marry the accused once he has offered her to marry.”

The court observed, that the alleged rape survivor has not been able to tell any particular date including year or month where the accused had refused to marry her. Also, she has not given any reason why she has not lodged any complaint when the accused had refused to marry her. The court found it hard to believe that she has been with a man for a long time but did not lodge a complaint when the accused blackmailed her with an obscene video he had allegedly shot. Considering all these reasons the court acquitted the accused.

The accused and the woman were in a relationship since 2013-2015. During this period they shared physical intimacy. The woman claimed that she had intercourse with man believing that they will marry but the man refused to marry her. However, she has nothing to support her claims and nor did she brought up the issue when they split.
