Husband suppresses his true income to pay low alimony
August 08, 2017A court while adjudicating a domestic violence case observed that in a lot of matters men hide their true income to avoid or reduce maintenance as claimed by their wives.
Additional Sessions Judge, Sanjeev Kumar noted that, “It is observed by the Metropolitan Magistrate that the income of the appellant has fallen down right after the litigation is initiated by his wife and the same has been done by him with the aim of defeating the legitimate claim of maintenance made by the respondent and her daughters.”
In the present matter, the respondent (wife) has filed a case under Domestic Violence Act.
On June 2, 2015, a magistrate court had allowed the woman’s plea and ordered the man to pay Rs. 16,000 each to his two daughters.
The man filed an appeal before the session’s court, the man’s counsel submitted that the maintenance income did not take into consideration the husband's net income and the court relied upon his gross income.
The magistrate had found that there has been a steep fall in man’s income. Between 2012 and 2014, the man’s income had fallen from Rs. 46.59 lakhs per annum in 2012 to 4.43 lakh in 2014.
The session’s court noted that man’s income had fallen drastically when the case was filed by his wife.
