Transfer of rent receipt on death of tenant

Buiding is 70 Years old.and we are tenants since 1964. If original tenans expires and co-tenant is grandson only. Grandson is having his name in rationcard,adhar card,licence,pancard,telephone bill duly transfer in name after death of original tenant,pancard as proof,still landlord is asking transfer fee though it is not sale but change in name of cotenant. The bldg is going under redevelopment. Is landlord has right to ask money or he can be force to transfer rent receipt legally without tranfer fee.pl guide as we have to take steps urgently.all parties are hindu

This would fall under transmission (not transfer) of tenancy. No transfer fee would have to be paid. This would be in accordance with the provisions of the Maharashtra Rent Control Act, 1999. For further guidance you may contact our firm which has expertise in rent control matters.
