27-Nov-2023 (In Landlord/Tenant Law)
Sir, I ,MCA, Asst Professor,TUMKUR, Karnataka working in SIT college,. BEFORE DIVORCE: I purchased a home with sale registration 30 lakhs and both owners : myself and ex-wife during 2014 Aug. She is Govt Medical Officer, Both applied joint loan and equally paying EMI.(16,000 + 16,000 =Rs 32,000 per month) Divorce Judgement : 2016 August month.( I filed DIV petition and got relief), Court also declared that She is not at all eligible to file any maintainance case due to her GOVT PROFESSION AND PROPERTIES) After Divorce: Her parents who were accepted themselves as TENANTS paying 8000 Rs/month in the police station. Now I got married with new partner and trying to move to my owned home. Now her parents stopped paying rents, managing Police ppl to separate me from my own home and shockingly stopped their EMI share since the time Judegement came. Here lawers said that court fees 14.5% which is almost 2.5lakhs I am not affordable to that plz tell us a bearable solution.

Its certainly a complicated case. Various documents like the Joint Ownership Sale Deed of the house, Home Loan Agreement, Divorce Decree and Rental Agreement, if any will have to be examined to correctly advise. It however seems clear from the information provided that forcible occupation by the ex-wife's parents is not a big issue.
