Tenant was staying without paying rent now want her to vacate.

Our father gave our property on rent to a man's daughter on goodwill, without signing any contract. My father passed away in 2013. Now, we have been trying to ask her to empty the house for over a year but they are not ready to do it. So we are planning on filing a case against them. We have all the legal documents needed to prove our ownership. Approximately how long will it take to resolve this issue?

It is never predictable that how long a litigation will go on. But an ejectment petition may take 2-3years. As it depends in which city you will be filing it and how much pendency of litigation is there, etc. So, there are number of reasons for delay.

Yes u have a valid right , enforceable in court to seek possession.
The title documents like sale deed etc in fathers name or will of your father will suffice. The fact that the plot was givenb as agoodwil gesture any evidence etc will also help.
