Tenant not ready to leave the house what action can I take?

We had made rent agreement and renew it every year, as per agreement both parties can give 1 month prior notice to close the agreement. Tenant says that he will leave only if he wants, you can't force him to leave. We have consulted a lawyer he asked to discuss and settle the matter negotiating g with Tenant as if this goes to court will take atleast 10 yrs for justice, also complaint to Police never helps in such matters. Need a legal advise,

If the agreement say that either of the party can give notice a months prior then can ask tenant to vacate if they refuses to do so. You can serve a legal notice to your tenant demanding rent due and ask to vacate, still if your tenant doesn't vacate then you can move to the court and file eviction petition against your tenant on the ground of non payment of rent due and other grounds available to you. Other grounds, will be assessed/made out by your counsel after discussing in detail with you. As it depends where you live and which Act is applicable to you.
