Tenant from 1982 no lease agreement how can I evict the tenant

My flat in Kolkata was rented out in 1982 - 1983 to a person on a personal lease. The relationship became very bad because he would miss rent payments.The gentleman with whom we had the lease agreement has died & his daughter is in the house now. She pays the rent & we had to give her rent slip on her name, but have no lease agreement with her. I requested an increase{since rent amt is not current mkt rate} she demanded that the entire bathroom is re-done , additional water storage put in etc. What legal option do we have, either she moves out or fresh lease with her & increased amount.

If the house needs repairs then you are required to make such repairs. In case of no rent agreement, you can evict the tenant if the tenant does agree with the increased rent. You can send a legal notice to the tenant for eviction. If the tenant does not evict then you can file an eviction suit.
