Tenant died brother using shop how can i vacate him

Mr.X took a shop on rent from Mr.Z some 18 yrs ago. Since last 5 to 6 yrs Mr.X hasn't been using the shop & his younger brother is using the shop for his personal purposes & also paying the rent. Mr.X died 3 years back & from then his wife & children have no affairs with the shop. Reciept of paid rent still comes with the name of Mr.X. Now Mr. Z wants his shop to be vacated by Mr.Y. But Mr.Y is not ready to vacate the shop. Mr.Z, the owner has sent a notice to Mr.Y& wife & 2 children of Mr.X to vacate the shop. Now how should Mr.X family come out of the case as they don't want the shop.

This would depend entirely on the lease agreement (or any other contract or document) that you have executed with your landlord. One would need to have it examined by a professional to draw a proper conclusion. It is doubtful that Wife's right to tenancy would depend on when Mr X passed away. What are the terms of the lease and had Mr Y and Mr X signed the lease jointly?
