Procedure to send eviction notice to tenant

Hi I gave my shop on rent 2months ago but tanent has not paid any rent till now. I rent agreement we agreed that tanent will transfer rent in my bank account only. The agreement is through nottery for 11months. There is also a condition in that agreement if tanent or landlord doesn't want to carry on. They can give 1month notice to come out of it. I have two questions (1) If I notify tanent to vacate the property in 1month and he doesn't vacate it. How strong I am in the court to evict it (2) can tenant claim that he has paid rent in cash although it's clearly mentioned in rent agreement that tanent will pay rent only in my bank a/c

Give the notice to the tenant for rent or vacat or Both. If thw tenant doesn't vacate in 15 days after raceive the notice then you have to file the suit for possession and damages and recovery of rent, if the monthly rent is more than Rs. 3500/-, if the rent is less than Rs. 3500/-, then you have to file a application regarding the rent.
Please, send your legal notice to the tenant through advocate for avoid complications.
You can file your case through attorney also.

aap us se apni shop khali kara sakte ho but uske liye aapko koi ek karan batana hoga ke wo 11 month se pahle ku khali kara raha ho uske bad aapki dukan khali ho jayegi and rahi bat aapki payment ki to wo aap apne account mai ya fir nakad le sakte ho

Hello, you can send him legal eviction notice after giving him 1 month notice and always can ask him for dues with interest. This is the case of breach of contract and legal action should be taken ASAP.

Don't worry, first of all you should send a notice to him for eviction of the said premises along with it mention the due rent amount with interest and mense profits as well, if he doesn't reply the notice can sue him for eviction and possession
