Possible to make entirely New Rental agreement with my old Tenant?

I have a case in the Lower court against my tenant's deceased wife and sons, which he filed against me when I asked them to vacate the shop, after a long time Court ordered my deceased tenant's wife and sons to vacate the shop and gave them two months time do so, in that period they appealed to the High court and obtained a stay order, Now the case is ongoing in the High from last almost two years. Now, one of my wife deceased's son wants to make an agreement and he says he doesn't care what we write in it. So, I am asking you, Can We make an agreement with him as an entirely New Tenant and closed the old chapter forever also can we also stipulate that he has to vacate the shop after the end of six months contract within one or two months without filing a case against us in any court.

if the case is pending before the Hon'ble HIgh Court i would suggest you to move an application or on the next date of hearing ask the court to send the matter to mediation as there is hope of settlement. In mediation you can settle the matter and get the terms and condition written on the settlement and the settlement can help you move forward.
