Paid token for property now do not wish to buy, can i claim it back?

We paid a token money of Rs. 10,000 to a landlord. However, we have now decided not to take th house due to certain reasons. However, not only is the broker/owner refusing to return the token. They also want us to pay additional rent as loss of income. Please note that we have not signed any agreement or taken possession of the house.

You must have reciept of the token money. Now you can issue a notice for cancellation of booking to the owner and broker and ask for the refund of amount. And reason for thw cancellation must be the inability to arrange the funds. If he is not returning the money or replying the notice then drag him to the court.

Hi. In the narrow conspectus of facts narrated by you, it appears that no refund can be claimed by you assuming that it would have been paid in cash without any receipt. The lanlord cannot compel you to pay any loss of rent or income.

You will not be liable at all to pay any extra money the broker may demand as there is no agreement between you two. Secondly, for taking back the money, since it's a small amount, filing a case would not be in your best interest. Send him a legal notice and then see how it goes.
