Neighbours harassing tenant and threatening me to file false complaint

06-Jan-2023 (In Landlord/Tenant Law)

I have given the flat to bachelors on rent in Pune. Society is yet not formed but for initial 2 years builder formed a list of rules and forced everyone to sign on it. That list also includes rule to not give flat to bachelors tenant. I have already submitted rental agreement along with police verification to the temporary society. Now my neighbours are threatening me that they will file a police complaint against me if I do not remove bachelors from the flat. They are also harassing my tenants. What legal action can I take against my neighbours?

You should approach the local police and file a complaint against them for harrasment, disturbing the peaceful use of your property etc. Your neighbours cannot force you to evict tenants and neither can your housing/residents welfare society even if such rules are framed. Do ensure that your tenants do not disturb their neighbours and you should not face any trouble. If you do then contact the police and file an application with the local magistrate to have an fir registered and to initiate a private complaint case. Feel free to get in touch if we could be of any further assistance to you.
