Landlord not taking possession if we file case do we need to pay rent

For years back we took one property on rental basis. We gave notice through email to the landlord that we are vacating the property as per the agreement. During the 4 years some wear and tear happened. We asked the owner if we should repair the wear n tear, he asked us to pay the amount rather than repairing it, which was humongous. We vacated the property property in June and he is not taking possession of the property. If we file case in court and it goes on for a year, do we need to pay rent for that time as well?

Since you have already send email, we further suggest that you send them a written communication again vide speed post along with your previous email. In this way you can take a stand that you have vacated the premises and in future you will not be liable to pay any rent, if he files any case before the appropriate forum.
