Landlord not refunding the amount deposited for repair work

15-Sep-2023 (In Landlord/Tenant Law)
I vacated the apartment on 22 Aug 2017 after 1 month notice as per rent agreement (registered). As the landlord do not live in Pune he asked me to handover the keys to one of his agent. Agent took the keys did the renovation and put the apartment on rent. I showed the apartment to agent before handing over the keys as there were no damages. Now after 3 weeks after many call which he did not received, sms, e-mails and whatzapp messages he refunded the deposit partially and remaining he said repair charges. I was never informed about damages and suddenly charged 10000 for repair. As I was never informed about damages I should not be charged with this. He is trying to recover the renovation money for new tenant. Kindly help how can I recover my deposit.

We need to check the terms and condition regarding damages clause at the time of vacating the premises. If clause say anything about damages at time of leaving the premises, then we are not entitled to received the deducted amount. If the agreement is silent about damages, then we can first issue Notice for refund of deducted amount, if not received after Notice, then we can file case in Court for recovery of amount deducted.
