Landlord not giving NOC to repair the property

My father got pagdi shop in mira road in around 1972...ow the landlord is not ready to give noc for repairs , not even allowing us to sell the shop & not ready to give ownership.. please assist what should we do.

Under the Pagdi system, the tenant has only tenancy rights. As far as repairs are concerned, Landlord has to give NOC for repairs. In case of non co-operation of Landlord, the tenant can do the repairs after giving due notice to the Landlord and recover the same by filing a suit in Small Cause Court of the respective area jurisdiction. the expenses that can be incurred is limited as per Maharashtra Rent Control Act and hence what is prescribed under MRC is what can be recovered from the Landlord.

Please discribe what you want to repair. As minor repair which is essential for living without damaging the structure you are eligible to do it your Landloard cannot stop you to do so. Else you have to approach court and take permission to repair it.
