Landlord asking us to pay full painting charges our of vengeance

12-Sep-2023 (In Landlord/Tenant Law)
The landlord and myself have an ongoing issue regarding the stray animals I take care of. We had a fight over feeding dogs recently and after that he asked us to vacate. He claims he needs the home for personal use but I know it's a vengeful act. He made me go through so much emotional turmoil too and on top of that I have to pay full charges for painting when I didn't stay for even an year. Is there anything I can do about this situation? I feel it's unfair to pay the money when he is making us vacate out of personal vengeance and using legal points in his favour. We went through the same with previous owners. I feel I am being ripped for no reason.

The relief you seek will depend on your lease/ rental agreement. The modes of termination and payment for maintenance and upkeep - such as painting will be mentioned in it. Without seeing it, I cannot give complete advice. Additionally, you will have to prove the "vengeance" on part of the owner if you want to claim relief for it. With regard to the painting costs, if your lease agreement is silent, then you can likely take relief of the law and seek pro-rata deduction of the painting cost for the period that you have resided in the house and claim reimbursement for the remainder. However, this advice is based only on the information provided by you and my opinion may change in case of additional facts and information given by you.
