Landlord asking to evict the flat after 6 months of occupying
15-Oct-2023 (In Landlord/Tenant Law)
sir/madam,we rented a 3bhk flat in may 2016.there was no written agreement between us and landlord, except a verbal agreement.we have said him before itself that we may end up living here for two years.but all of a sudden after 6 months of tenancy now he asks us to evict saying that he wants to sell the flat as he is facing loss by giving it to rent.so we asked him to give us 3 months of time so that we already started the construction of our new home.within 3 months our new house will be ready to occupy and so we can leave after 3 months .but he is not agreeing to us and still asking us to leave within a month, however he had asked us to leave after the 3 months of stay . we came in the month of may 2016 he sent us notice in september 2016 asking us to leave and we are asking him to extend our time of stay till january 2017,which he is denying.so do we have any rights legally? is he correct in asking so?
If you have a written lease, your landlord probably has to have a reason to evict you.
If you are a tenant at will (no lease), your landlord can evict you without giving a reason. However, he must give you 7 or 30 days notice in writing. Landord can evict tenant only on grounds of bonafied requirement or if tenancy terms are voilated . He cannot arbitraryly evict a tenant from rented accomodation . If he do so , tenant can move court .
