I was asked to vacate the house within 12 hrs by society association
13-Apr-2023 (In Landlord/Tenant Law)
4 bachelor girls lived in 3 BHK flat. I was alone and called my friends over after that things got out of control and they took beer bottle downstairs near the pool after midnight. The society association president was going to airport and when he saw the lights of the pool area on he came to see , and then started abusing and yelling . We all apologized but he didnt listen.
After two days he called one of the flatmate and yelled at her and asked her to throw me out within 12 hrs or else all of us vacate .
I vacated within 12 hours itself and he is still harassing the other 3 flatmates who have nothing to do in the entire incident.
He has not talked to me at all , does want to talk or take written apology/undertaking .
The owner of the flat has no issues she says do whatever the association says.
Is there anywhere the law can help me . I made a mistake and am ready to apologize have even moved out then why troubling the others who were not even part of it.
No the said person can not ask you for eviction with such a short notice. Also, you should not leave the said leased property i.e, the Flat. Also, you can file a case against your eviction in the civil court. You can ask your flatmates not to evict the said premises. Also, you will have to look into the agreement the landlord signed with the association as if there is any clause regarding such eviction and if not then, on the first hand you are not liable for anything, you can initiate a civil case against the housing society. You can also, file a police complaint against the said member for criminal intimidation under section 506 of IPC.
