How to evict tenants if not doing so

12-Jan-2023 (In Landlord/Tenant Law)
We are an old couple Myself and my wife aged 66 and 64 years respectively. We have rented out our house to a tenant who have been there for 7 years. We wanted to sell the house and the tenat was interested to purchase. We gave them time on the condition that they will have to vacate if they did not do so within the time limit. They have not doen so under the pretext that there is a temporary ban on registration of propoerty . So we told them in that case to vacate since they are not going to buy that house any way. We decidecided to move in ousrselves . Our tenants are however prolonging the issue not showing an inclination to vacate . Please advise us about the course of action

You could file a transfer petition in the supreme court as in this case two states are involved along with a stay petition for staying proceedings in kolhapur court during pendency of transfer petition. Once the supreme court allows your transfer petition the case will be transfered to the chennai fc. Here you could continue your hearing.

Sir, you have to approach the rent control court to evict the tenant from the premises. If there is no default in payment of rent then you have to file the eviction petition under the ground of additional accommodation or own use and occupation. But, at least it will take 2 to 3 years to get the eviction order from the court.
