How do I get tenant to vacate my house, what can I do ?

We have property under joint name and the portion which we own is half rented to the tenant since last 40 yrs. Now he owns his own house and have moved there since more then 6 months. However, he demand 15 Lac to give possession (Its a 1BHK). As its a very old construction we have offered him 2 Lac to get possession. The property is locked and he have his furniture and few stuffs lying in there. If I file a case in court, is there a chance for me to getting my property as he owns his own house now? "Any proof that I must submit to the court, to make my case strong". I prefer settlement but at some affordable price. wherein he is not ready for negotiation. Please suggest.

The eviction of your tenant legally will be governed by the lease that has been signed between you and your tenant. Most of the lease agreements have a clause of notice period of 1 month from either sides to vacate the premises.

To begin the legal process of eviction, you may send a legal notice to the tenant and even after that he does not vacate the house, you have the option of filing a suit for eviction against your tenants on the ground of bona fide requirement under the Rent Cotrol Act.
