How can I vacate the tenant in case of absence of rent agreement.

I have a shop which I had given on rent without any rent agreement in 2014. I want to evacuate the tenant but he is refusing to vacate. How would I vacate the tenant even I don't have any rental agreement? Should he go to court for not evicting?

You may send him legal notice under section 106 Transfer of property act for the eviction of tenant as the tenancy is considered as month to month tenancy and then file suit for possession, arrears of rent, permanent injunction in competent court of jurisdiction.
The only problem will be the amount of rent.

You have no option but to go to court.the appropriate court i.e rent tribunal or civil courtwill be as per the place where the property is situated and the rent being paid. The tenant shall have to prove under what circumstances he is in posession of tge premises.

Yes can go for court for restraint and you have to established your bonafide needs and non payment of rent on the part of tenant then you can file for eviction petition but you have to served the statutory notice through lawyer
