Eviction of Tenants under Padgi System

19-Aug-2023 (In Landlord/Tenant Law)
Sir my family owns few number of shops in a building in Old Delhi which have been rented under Pagdi system to different people by my grandfather. We have the ownership documents of the respective shops. I want to know the legal recourse to get our shops back. Also, on the other hand can we ask for the rent for these shops with respect to today's market rate?

Under what agreement your grandfather had rented out the shops? Was there any duration? Any written document between the two parties? For eviction of the tenant you may send them a legal notice initially to give them some time to find them a new place or you may also write that in case they want to continue running their shops a Monthly rent would be fixed which is to be paid. If they agree to your condition you may make a lease deed else you can ask them to vacate the premises.
