Evauation of a 45 yrs old shop

My father is a shopkeper (india)having a shop on rent from near 1990 but the building was made near 1883 .now the owner of the whole market(some other ships also) and some attatched empty land has been sold and we are being asked to leave the shop and take a small amount of 12 lacs. We are not ready and are asking for a new shop( we are ready to pay money) or increase the anount from 12 lacs. Today the development authority put a seal on all the shops.there were some shops unoccupied so first the owner of the land braoght them down but now again started building them and stopped in bw by seal.

If you were not paying rent for the said property since last 12 years and enjoyed the possession uninterrupted then, you can claim adverse possession over the said property. For that you can file a civil suit in the Jurisdictional Civil court.

Look, if you proof that your father is a Tenant, then go to Civil Court and asked for Injunction otherwise, settled the matter amicably. In most of the cases we found that, the Tenant have no papers at all for proof his tenancy right. And ultimately he bound to compromise with the Landlord.
