Commercial Activity in Residential Apartment

One of the owners rented a flat opposite to him. As he is a tenant of the second one he started a commercial Godown in his flat. He has a godown of undergarments in that flat. When questioned he stated he could get written majority approval from association of owners. Now is it legal to start a commercial activity in apartment?? Also isn't it a security threat to other owners??Also does he need to get prior permission from Municipal authorities for this??..

The sanction of the municipality for construction of residential apartment in itself is a condition that no commercial activity can happen in such apartment except the owner can use such flat for his own business or profession. You can complain to the municipal authorities about the same if it is let out to third parties for commercial activity and also get a stay from the court restraining the owner of such flat letting it for commercial activity.
