Can we ask a tenant to vacate in case he is there from last 50 years

08-Dec-2023 (In Landlord/Tenant Law)
I have a very old tenant ,who is there from my grandfathers time, so obviously there is no tenant agreement b/w my grandfather and tenant ,both are expired now. Now his son is continuing and not vacating the Shop. We filled a HRA case but now he is claiming the shop to be his own property. What can I do best in this situation.

If there is no agreement between tenant and land Lord , then the tenant is claiming as a owner under adverse possession

Instead of filing HRA first you could have vacated him from the shop through Illegal means in one night .

Once vecauted then even if tenant complaint he cannot claim adverse possession.
In the absence of rent agreement tenant cannot lodge complaint against you also.
What is the ground taken in HRA is not disclosed.

sir, If tenant ship is admitted by the tenant and rent is being paid by him or he paid the rent and admitted the same , he can not claim adverse title. If he has denied the property title then i have tot see your H R C petition and main objection to further opinion.
