Can I keep the advance money if the tenant did not occupy

A prospective tenant gave me an advance of 100000 for a house and verbally agreed to a rent of rs.35000. They took the keys after more than a month. We also made changes worth rs 30000 in the property as per their requirement. After two months they returned the key saying they didn't want to occupy. They did not sign an agreement though it was sent to them. I have kept the property for 5 months without renting waiting for them. Now they're asking for 70% of the advance. Am i allowed to keep the advance towards rent and expenses incurred.
You can reduce the amount towards the rent and pay back the rest of if the rent exceeds the advance amount paid you can claim from them. However in your case no agreement was entered into and amount paid in what form is also not said. Please clarify for better opinion
