Work not delivered still due to which we are bearing loss

Dear Sir or Mdam: We are based in Iran. We signed a contract with a web design company 7 months ago and transferred to them the whole contracted amount. The job was set to be fulfilled in 3 months maximum, which is stated in the contract, but by today after 7 months our portal is not handed over to us. We are losing money day by day because the business is losing its advantage, we are passing the high season. What shall we do? Where can we open a legal case? How long does it take us to get a result? What are the chances of succeeding?

From the information furnished it is to be presumed that you entered into contract with genuine Indian business partner, what about your communication with them? what did they reply when you asked them to fulfill the obligation? is there any arbitration clause in your contract? check up these matters otherwise write to the commerce ministry in India to get details of the party who has assured you to fulfill the obligation on their part before approaching the Courts in India it may be time consuming and expensive.Also write to Prime Ministers Office in India explaining your predicament and send a copy to Commerce Ministry as also to the party before legal steps are taken..

if you have paid for a service that was sought to be delivered to you within a fixed period and if the same is not delivered, then you first and foremost get issued a legal notice asking for immediate compliance if the same is not done, then proceed to file a consumer complaint seeking for complete refund of your contract money, along with damages and compensation together with litigation costs and interest on the contractual amount till date of realization.
Thereafter move this contract to another entity pay an advance promising to pay the rest once the product is delivered to you. Provide proof of this payment and claim this amount also from the defaulting client.
