Will the employee be terminated if in prison? How to proceed ?

My brother is a government employee. He is facing a false case under sc/st act of calling by caste and charged section is 3(1)(x).so what will be punishment if he found guilty and in case of prison for 1 year or 2 will he be able to rejoin after completing the imprisonment period?
No, the government can remove him from his post and duties on the sole ground that he is convicted under the said sc/st act and shall be reinstate only he will knock the doors of judiciary and file his representation as a writ in the hon'ble patna high court. then only, he can be reinstated back.
