Who has the right over the accidental benefits

Hi Sir/Madam, My question is regarding accidental Benefit of Govt Employee. My brother-in-law recently expired on duty due to accident at work. We were told that 7.5 lakh rupees cheque has been disbursed as accidental benefit and it will be given to my sister and her kids through labor court. Court has distributed amount and gave 2 lakh ruppes to the parents who get pension from railway as retired employee. I am not convinced that my brother-in-law's parents should be getting anything out of that cheque as they are pension holder and have 2 more sons to look after them. Please advice

As per your query, in order to challenge the order given by the court you can file an application in the higher court stating the same. Once you have taken the case to a higher court, it would be up to the courts discretion to quash the order or not.
