24-Jul-2023 (In Labour & Service Law)
I am currently working in a software company, then I got a offer from another software company and I am wiling to join it. I have given a resignation which serves notice period of two months. So technically it will end up in 2 September but I have to join another company before 15 days of notice period, but my current company is refusing to give the reliving letter before 15 days of notice period. What should I do, would you recommend me to give them a legal notice

Serving of notice is mandatory in corporate environment. Its done basically to severe the relation of an employer and employee and you put on notice the employer or employee as the case may be for their arrangement and not taking by surprise.

If you have not served mandatory notice period you may be held liable for damages, as you left the job without any intimation or in case any agreement for basic salary pay.

You may have left job for whatever reason, however, it is mandatory on you to serve mandatory notice and on completion of notice period you ought to have leave the job. When you left the job without serving mandatory notice, your will have to pay notice period salary to the management.
