Want to apply for maternity leave also entitled to get 2months salary

24-Mar-2023 (In Labour & Service Law)

I am a pregnant employee (4 months) who has been working in an IT Public Limited Co in Kolkata for nearly 6 yrs. Currently my Company employes about 450 employees. They are downsizing and now looking to revamp/change the entire Finance department (of which I am a part). They are asking me to resign. What should I do to to ensure that i atleast get my maternity benefits. If i resign, I am entitled to get 2 months basic salary as notice pay (as per my appointment letter). What should I do?

If your company does not want you , no force can be applied to retain you.
If there is job contract both you and the company is bound to honour its terms.
So you are entitled to 2 months of notice pay but no maternity benefit sine you are getting retrenched beofre birth of the child.

Dear client,
You have to issue a legal notice to the company for the disbursement of yout maternity benefit. If not replied within time then file a case before the Labour Court for the disbursement of the Maternity Benefit.
