Suspension for violating code of conduct without trial, please advise.

I am an odisha govt employee,suspend from service on the complaint of media people by collector sundargarh without any trial,source of evidence media footage,i had only appeared in gathering where local mla was also there,and presently panchyat election is going on.

Yes,About the panchayat act that any govt employee can't share or help any other political parties. so,if strong direct primary evidence avail against you or any video clip that must be important for your case.Photo image not important, if you prove that you are appeared for any orgent circumstances then it is manage.

Without an inquiry,not serving Show Cause Notice on you, not providing documents & evidence addsd during inquiry, not allowing u to defend,suspension is against Principle of Natural Justice, Illegal.

Has any kind of department enquiry been initiated against you, has there been any show cause notice issued to you? If the answer is in negative, then you can approach the appropriate court of law challenging the suspension order as the same would be vitiated by non compliance of principles of natural justice.

You should immediately file a representation before your appointing authority asking to revoke your suspension orders and seeking clarification on what grounds/charge have you been suspended.

In any case you cannot be placed under suspension for more than 3 months in view of certain recent rulings by the Apex Court.
