Salary Payout and Notice period issue by employer

Hi Sir/Madam, My company has a notice period for 1 month upon separation. I gave my notice in the beginning of the month (say on 5th October) and currently serving my notice till 5th November 2016 My Employer has not paid me for month of September 2016 till date. and I know that the salary for October will be paid in 45 days of my separation from the company. Has the company right to with hold my salary for 60 days + where as my notice period is 30 days . "There is no written statement in my employment contract as well" I go to my employer and they just keep routing me and passing from pillar to post. Please update me on my Legal rights on the same .

You can file a written complaint with labour commissioner with all the details including appointment letter and termination as well. The matter will be taken on board in labour court and the matter will be settled on priority basis

It this respect i would like to upgrade your knowledge to the extend in case they retain , then you can file a civil suit. Before that i would suggest you to please serve a legal notice by name of employer. The notice effect is sometime effective and try to serve the so called notice from some high court advocate or a law firm.
