Salary not dispensed by senior officer is it considered an offence

I want to know that can salary of a State Govt(UP) employee be stopped/not dispensed by Senior officer even if there is no case of suspension or departmental enquiry or leave problem? Is this on the will of Senior officer to dispense the salary of juniors ? Also in such a case a junior can ask for 24% interest rate ? It will be great help if you could provide reference of any previous judgement

Salary payable to an employee can't be withheld even if there is a pending enquiry against the concerned employee. In normal circumstances, witholding it is a sin and violative of fundamental rights. Interest should be payable in case of delay in release of the same.

It is not a specific rule that every calim vsn be given with the 24% interest upon compensation it is depend upon case to case and facts to facts but it is also illegal if they have stopped you salarey without any reason make a representaion and after that file a writ petitin before the concerned high court
