RETRENCHMENT OF A FACULTY WTHOUT PRIOR NOTICE

I AM WORKING AS AN ASSISTANT PROFESSOR IN AN EDUCATIONAL SOCIETIES COLLEGE SINCE JUNE 2016 , ON DATED 18 SEP 2017 THEY GAVE ME A LETTER THAT MY SERVICE IS NOT UP TO THE MARK AND MY SERVICE HAS BEEN TERMINATED FROM 15 SEP WITH GRACE PERIOD OF FIFTEEN DAYS FOR MY DUES SETTLEMENT. CAN I GO TO THE LABOUR COURT FOR THIS MATTER. BEFORE THIS THEY HAVEN'T GAVE ANY NOTICE TO ME REGARDING MY SERVICES .

Dear Professor

my immediate advise to you would be that if your have served more then 240 days then serve a comprehensive legal notice upon your employer and consult a lawyer with your offer letter prior you receive a termination notice to pursue for filing a case before labor court to save your job and consequential benefits.

Before going labour court. Let me know about your salary package. Are you on contractual period or on probation period?
What was your term of services?
Were you a regular employee?
Part time employment.

Aapka matter education se related hai so is tarah ke maamle education tribunal me lagae jaate hai. Sampark Kare aapki samasya ka samadhan jarur hoga. Aap yadi vyaktigat rup se mile to kuchh kaam ban sakta hai.

You should follw the procedure as given below:

Instead of going to the labor court, you should approach to the educational tribunal aided or not aided.
