Resigned after 2 months without serving notice period what can I do

I have resigned from my duty just before 2 months of completion of my services for the purpose of pursuing a course. My contract is silent for any probation period. My contract states for 3 months notice period or 3 months notice pay in both resignation or termination case. My company is asking me to serve 3 months notice period or recovery on gross salary if served for lesser period. I feel for two months working 3 months notice period is not justified. Please advice.

Your service in the private sector is based according to the employment agreement. If your employment contract mentions that you need to serve notice period of 3 months, then you are required to do so. If you don’t serve the notice period then the company can take legal action against you.
