04-Sep-2023 (In Labour & Service Law)
I work in a small IT firm.I resigned 1 month ago and was serving my notice period.Just days before release I got caught when I was copying source code of an application(written by me)in my personal pendrive. My intentions are for future study purpose only and not for any commercial purpose.I dont owe any business or not associated with any other business organisation. Now they are accusing me of theft and sent a termination letter and threatening me to take action against me.I am about to join a big mnc within one week.what should I do now?

This could possibly be a violaton of the rules of your Company. When an employee does any work for the Company, including writing codes or creating products - the employer becomes the sole owner of that property. This may also be stated in your employement agreement / handbook /Company rules. Please go through your company rules and check. I advise you to negotiate with your Company, apologize and settle the matter so that you can end this issue here. If not, this may become an issue in your new company when they conduct a background check.
