Regarding legal action on leaving job
21-Jan-2023 (In Labour & Service Law)
Hello Sir I was working in a recruiting firm and signed a 1/½ year contract with them as a fresher. I left the company after 4 months, as i am getting married and needed time off, buy now they have sent me a mail mentioning to pay them the fees for their training program and all or else they will be taking a legal action against me. Actually mu fiance is a US citizen, and i am afraid that any legal action against me will result in getting a bad name with the US embassy and they can reject my visa which i will be applying by the end of the year.Though many people have left the company earlier and recieved similar mails like me,but no legal action was taken before, still I am concerned. Please walk me through this. Thank You
As per the recent development in law made by the Supreme Court and various High Courts, such bonds are lopsided and are not legal and enforceable under law.
You can send a legal notice to the company for asking for your dues.
If the company takes any legal action against you to ask for the bond amount, you must contest it in the court of law as the enforcement of these employment bonds is not maintainable under law.
