Regarding Illegal Termination with no Salary Paid

09-Apr-2023 (In Labour & Service Law)
Hello Sir/Madam, I was employed as a permanent employee by my company and its been 7 months from now. However, company told me to resign from my job and you won't be getting any salary and other benefits as you are no longer related with our company. But as per the offer letter , it states that neither employee nor employer can terminate an employee with a three months prior notice. But I was terminated on the spot and no benifits would be given to me. Kindly advise me on what further steps I can take further.

Hello,
If the employment contract (the offer letter in your case) provides for a three month notice period prior to termination of employment, you will be entitled to the same. Would advise that you issue a written communication to the employer referring to this Clause and your rights under the same. If the employer fails to make the payment after that, you may consider the issuance of a legal notice to them calling upon them to make the payment of the amounts due.
