Received notice from company for notice period salary what to do

30-Jan-2023 (In Labour & Service Law)

I left the company I joined after just 3-4 days. I have got some letters of reminder and then termination. After 8 months the company sent me another letter asking me to pay the notice period amount (3 months basic salary). It was there in the joining day appointment letter. However, is it legal for a company to recover it from me? What can be the consequence and actions I can take to handle this. I don't need exp certificate from the company I left. Pls advise.

No, you are not required to re-pay the amount unless the amount is by way of a penalty and was not actually spent on you, such as expenditure for training. If the matter comes before a court of law, the court will examine whether the company had in fact expended the amount of money they are now claiming from you. Feel free to get in touch if we could be of any further assistance to you.
