Procedure to become petitioner of existing case

Sir/Madam, we had filed a case on CGHS for regularization of our contractual services in CGIT, under section 33 we were given the stay by same court in job continuation till case ends, but CGHS didnt follow it, so we had to seek the stay from high court new delhi, now..our labor case and high court case has only 3 petitioners i.e. our colleagues and remaining 215 guys working on contract have also got relief in the same case though we are not part of that as yet.Now, our main petitioners have threatened to remove our names from the case---what can be done in this case,how can we bcme petitionr

Becoming a petitioner to an on-going case requires an application under Order 1 Rule X of the Civil Procedure Code. You just have to state how you have sufficient ground to become a petitioner in the application, and you'll be impleaded in the matter by the concerned Court.

Your query does not reveal whether you are party to ongoing litigation in High Court. As stated you are not yet part of the case, but you also say that main petitioners have threatened to remove your name. If you are not party how can your name be removed. And if you are party your name can not be removed without Courts permission.
I think you require to visit with the case file in order to examine the matter.

Hi first thing that your name can not be removed without your consent of application, if you are one of the petitioner in this case. If not you can still continue taking advantage of the same case if you are similarly placed as others. You can monitor the proceeding online if you have case details with you. You can file WP separately and get your case tagged with existing case. Avail the option whichever suits you. Regards

Have you given any kind of authority in writing to the existing petitioner to fight the case on your behalf? If yes, how can he remove his name without your petitions final decision.
In case you are not a petitioner and want to add your name then you can move an impleadment application saying that you are an effected party and your rights are also at stake, so, your name be added in the list of petitioners.
