23-Jun-2023 (In Labour & Service Law)
I was working in software company at client location. I resigned from the company and got relieving letter from company. But company is not giving my 2 month salary. When I talked to HR she told me that client manager has not approved your timesheet. I have mail time sheet to client manager for approval but she has not approved. I have sent many reminder mails for approval of timesheet but she has not replied. Please help how I can get my salary.

Did you enter into an employment contract with your employer? If yes, then do share the details because it would contain a clause regarding resignation and payment of salary in lieu of notice period. If not, then you should immediately send a legal notice to your employer and demand payment of your dues and if your company then fails to pay then you can approach the appropriate labour court for redressal. you have done good efforts. now you shall file a petition in labour comissionor under the payment of wages act 1936. According to the provisions on the payment of wages act they have made the salary on or before 10th day every month. so company has committed the breach of llegal provissions. you can also made a complaint in labour court also.
