Previous employer refused to pay my last month salary

I was working with a tution centre on part tym basis and I got full time job in other institute so I have told them about quitting before 1 week of joining. Now they are saying that I have to serve 1 month notice period... but I haven't signed any service contract with them and they haven't mentioned about notice period earlier,when I was joining their institute. My due amount with them is Rs 10000 which they refused to pay.

Before answering your quary you have to give us all th details as whether you hav appointed by appointment letter, whether you used to sign on any attendence register becozuse you have to establish first that you were teaching, then you can file a complaint to recieve your salary

Since there is no contract you too are not bound by any such obligation on your part too. However you must have pro9f of such employment. The relationship between you and your employer indicates an unwritten contract.
You can serve a legal notice upon the employer and ask him to pay.

It would be better if you consider yourself as a professional engaged with your previous organization on a part time basis.
Till the time you will consider yourself an employee even if on a part time basis all the employment norms will be there to be followed back whether if it is written or not. (they may draft their employees policy and bring it before court defeating your case)
And in the capacity of a professional engaged in parting services on the part time basis ask for your dues by the way of legal notice.

You could be given proper advice if you let me know as to how many workers were working in your tuition center ? Did the management offer you a letter of appointment ? whether terms and conditions were mentioned in the appointment letter ? Usually the minimum notice period is one month for leaving a job. However you can be given proper advice if you give full account of your case.
