Previous company not giving my relieving letter
26-Apr-2023 (In Labour & Service Law)
I have resigned from from my current employer on 25th Feb,completed serving 2 months notice and ready to surrender a months salary for shortfall of notice period. I have to join my new employer on 9th May, but the employer is not relieving me,forcing to stay till 24th May and complete 3 months notice. I work at a client's site. Employer HR has threatened to abscond me if I stop reporting to client's office. Can they block my experience letter if I walk away on 6th May?
If there is any written communication with you and the company you can use it as evidence that they agreed to relieve you and promised to provide the experience letter. You can send them a legal notice asking for your experience letter and full & final settlement if any. In case there is not reply from their side you can file a case in civil court.
