Paying salary to employees without written proof can they sue me

19-Feb-2023 (In Labour & Service Law)
I have employees working with me more than 25 years in my concern.i am paying the monthly salary regularly. I dont have any written proof such as signed vouchers with me which proves that i have paid their monthly dues. Can they sue me legally in the court of law? And all of them are near the age of 60 years..is there an age criteria an employee can sue his employer?

Please take note of following -
1. Not getting signatures of the employees to whom you are paying their salaries technically means that you have never paid them anything as their me sum for the efforts they have taken as an employee for your concern.
2. There's no age limitation to sue anyone for the dues which is due at the part of defendant. Limitation period is calculated from the date of cause of action which is continuous in your case (not paying the salaries to your employees from so many years and till now).

The answer to the second part of your question is: No, there is no age criteria for filing any complaint in a court of law. The answer to the first part of your query depends upon a number of factors:The nature of employment, the number of employees, whether you were covered under the EPF Act etc.?

Whether you are paying cash payment to your employees? In private job there are not any age boundations of the employees to sue his employer. Are you maintained your account regarding the payment of your employees and other office expenses. Please give me full and proper information regarding the same.
