Not fulfilled conditions of tender what to do

All tenderer were required to submit a satisfactory certificate. Non of the tenderer submitted the satisfactory certificate, however we opened both the technical and commercial bid. Thereafter all the vendors were asked to produce the satisfactory certificate. L-1 vendor did not submit the satisfactory certificate. Thereafter tender was awarded to L-2 who had submitted the satisfactory certificate. L-1 vendor submitted the complaint that why my commercial bid were opened when I have not fulfilled the terms and conditions of the tender.does this make the tender null and void and we ahve to go for retender . please guide

No you are not required to opt for re-tender as you have followed the due procedure for the same which the L-1 tenderer did not. As he/she failed to comply with the terms and conditions of submitting the tender, thereby disqualifying himself/herself from bidding.
