Maternity Benefits Partially Denied by Public School

This is regarding my wife, she has taken ML initially from Dec to Feb & extended to June from the school where she was employed for last 2.5 yrs. As per the school, the maternity benefit is of 3 months leave out of which only 1 month is paid and rest is unpaid. The school has paid only 1 month salary in by wife’s bank account. Now my wife has resigned and left the job. Can we claim the remaining 2 month’s salary as maternity benefit from the school under MBA 1961? My wife was given just the offer letter that mentions that "you are joining upon the mutually agreed terms and conditions."

Yes, the 2 month unpaid salary for the maternity leave can be claimed. Make a representation to the school first and if they fail to do the needful, approach the high court by way of filing your writ petition, for I presume that the school receives Govt, aid and thus a writ petition against them is very much maintainable.
