Is it mandatory to serve a notice period in a company

Hi Team, Working with a Pvt.Ltd. Co. which has a clause in Offer Letter that 2 months of notice period needs to be served in case of resignation and same company will do in case of sepration. Also, no buy out option. Would like to know is there any way we can avoid this notice period and is this legally bound that we have to serve notice period of 2 months What if a person is not well and he/she is suffering from some illness What if somebody is not well in his family What if he is outstation candidate and he can not serve notice period due to family condition. Could you please advise.

Private employment is governed by the employment contract or the terms and conditions mentioned in the appointment letter.

If there is a clause with respect to serving the notice period, then it has to be served and since there is no buy out clause, you can request the HR in case of severe family condition to provide you a buy out option.
