IPC act applicable for delay disbursemnt of salary & compensation

Dear Sir / Madam, This is somnath basak worked in a Ltd Company from 2014, but every month company not disbursed monthly salary timely. Now i am leave the said company on 15th nov 16, but till date salary from aug 16 & onwards is due. I also send many mail and reminder to the concern person but the problem not resolves from their end. My question please guides me which act is applicable to recover the all due amount and additional compensation for delay disbursement of salary.

Dear Mr. Basak,

Thank you for the question. You have'nt mentioned whether it is public ltd. Or Pvt. Ltd company.However if it is public ltd. Company you can utilize writ jurisdiction of The Hon'ble High Court along with the concerned service rules or else in case of a private limited company labour laws for private companies shall be applied in accordance of the nature of your company.

MY OPINION THAT i have follow your matter,& i think that you have legitimate claim to recover your dues of monthly salary from the concern ltd. company & for that so many legal fields you can avail to recover the dues & take instant legal action against the concern ltd company.

You can file a money suit against your previous company for recovery of the same. You can also seek for interest on account of harassment and interest due payable for that period thereon. But prior to all these you should send some legal notice to substantiate your case.
