How to recover pending salaries from corporate company

Dear Sir, I was worked and resigned my services in one of corporate company. They are not paid my last 3 months salary. Past 1 year i have been following up with them orally, directly and through mails also. Even i marked directly to chairman also. Still date they are not replied any mail. Even they are not paid my PF & TDS amount past two years to the govt. Like this lot of employees are facing in this organisation. Kindly help us how to go about this to recover our dues. There are 2 methods to effect the recovery. 1. filing a criminal complaint with the police, if they are unwilling to accept the complaint, then proceed with filing a private complaint at a magistrate court; 2. if they are not responding to a legal notice sent through a lawyer, then proceed with filing a civil suit for recovery of salary dues. regarding PF, you can file claim even without the signature of the organisation. Regarding TDS, if you are sure that they have not deposited your TDS (can be seen from Form - 16), you can lodge complaint with IT authorities, too. Since you have mentioned that there are several employees who are suffering, collective action is a better option.

Even a big organisation like Kingfisher is a defaulter of TDS deposit.
